I know that MOU are not enforeable in court of law. But even if the parties to the MOU partly act according to MOU , in that case can it be fully enforced by court.

one MOU is made between 6 legal heirs say A,B,C,D,E,F to share some property in certain ratio. It is further agreed that A,B,C,D,E will give F 10,000/= each for expenses regarding search of property and issue a registered power of attorney for this.

Subsequently according to MOU, ABCDE paid Rs 10000/= each, to F and also a registered power of attorney.

Now question is that after the part execution of MOU, can it be chellanged in court of law even when parties to MOU have already partly acted according to MOU.

I am in position 'F ' aforesaid case. I have doubt that if any ancestral property is retreived by me, thereafter the other parties to the MOU may challenge it and may demand some higher percentage in the
property than what is agreed in the MOU.

From your reply, it is clear that right now you don't have any problem.

Presumptions have no relevance in law. You may come with your query only when some problem really arises for you. Otherwise, if some preventive advice is required, you may hire services of some expert for advice by getting contents of your MOU examined properly.
