Loss of salary due to accident

(Querist) 18 April 2014 This query is : Resolved 
Due to my accident by a drunk car driver, I lost my two months salary.

I am already filed a case in the court.

My question is that whether by submitting all the salary documents on company's letter head can the court will satisfied OR company's representative should appear in the court.

Kindly quote any section number.

insurance will not cover drunken driving.so whom are you filing case against?
if the driver is company employed,the company may be able to make some alternative / suitable adjustment, for a financial compensation to both of you.

You have suffered an accident. You are entitled for compensation from the owner of the vehicle/insurer.

It is not your concern to plead or prove that the driver was drunken. Leave it to the insurance company.

I think I was not properly passed my query.

Court needs to verify my salary loss.

And my Company said that they can provide my salary loss amount on letter head but they are not interested to appear in the court by a representative.

Can the court will satisfied from the letter given by Company?
OR
Whether the company's representative should appear in the Court?

Please mention any section or case law.

You yourself can introduce and prove the salary certificate. If need be you can provide corroboratory evidence in the form of receipt given by you or the statement from the bank.

insurance co as well as your employer liable to pay you.
to-fro for employment is covered, as if accident at work place. check c ur union.. safety/ welfare officer.
