Lock in period in leave and license agreement

(Querist) 01 May 2017 This query is : Resolved
Whether a licensor can ask the licensee to vacat his premises after expiry of lock in period 3 months during the tenure of leave and license for the period of 11 months. The leave and license agreement is made for 11 months and it is still continuing. The licensor issued a one month notice to the licensee asking him to vacate the premises. What should I do against their act and is there any interim relief or should I go before the Civil Court or should I file any SUIT.WHAT IS THE RELIEF.

Since there is a covenant in L & L agreement, which you have agreed, to take the possession of demised premises on "one month's notice", which the landlord has already issued, he do not want you to continue as his licensee, you have no legal option but to hand over the possession of the premises.
At the most you may discuss your problem, if any, with the landlord for re-consideration.

Is there any time limit for lock in period.

If you no default on your part you can ask the lessor to continue the same on mutual trust and confidence until you get a new premises. Alternatively you can consult a legal counsel on its validity to defend your rights for the promised lease period.

PROPER REPLY CAN BE GIVEN AFTER REFERRING THE TERMS OF AGREEMENT.

Discuss with local lawyer.
