Lien clarification

Sir. I had joined central government department in the year 2009 but even after succeessf completion of 4 years I did not get the confirmation order then I joined another central government department in the year 2013 and after working there for two years and eight months I again joined another job of state government in Nov. 2015 and applied for lien in my previous department, where also I have not been given confirmation order, however they retained my lien and now I come to know that no lien can be retained without getting confirmed on post. Kindly clarify can my lien be terminated as

Whatever you have heard is true and correct. No lien can be made unless service is confirmed hence even if earlier department had given to you lien right even then the same is given mistakenly and it has no legal value.

But even after lapse of nine months they did not make any correspondence can I revert to my parent department at this stage and what will be the consequences as I had been given lien for a period of only one year which is going to expire in Nov. This year and what if I apply lien for another year

If the lien for one year has been granted which is going to expire in Nov. this year so advised to immediately opt for that option. Extension for another year is the prerogative of the parental department.

You have not replied my specific question.

If as per your statement, the lien is still to expire in Nov. 2016, what type of problem remains there for which you posted your query?

In that case your incomplete query, "Kindly clarify can my lien be terminated as" has no legal standing, as this is purely a premature question that too relating to an administrative process. Right now you don't have any legal problem. If you have any query, you may better ask your department, which has kept your lien.

I endorse your your opinion. He may not be knowing even the definition of lien, who can hold lien, why & for how many years that is maintained or when can be terminated. It seems, the querist is merely shooting in the air in a bid to get his academic query solved.
