How to get legal heir certificate to get properties of my father transferred to my name

Usually it is issued by O/o Tehsildar after inquiry by revenue officials.

1. "Legal Heir Certificate" obtained from any authority is grossly insufficient for purpose for transfer of immovable property.

2. "title-ownership" of immovable property CANNOT be transferred based on any "Legal Heir Certificate". Proper due procedure of law and documentations are required for transfer of immovable property.

Legal Heir Certificate is the most important primary document which is most essential.Certifying it as "Insufficient" is Pure Exposure of Illiteracy,Ignorance,Inexperience and better to be Ignored.

First which state property is located this determine few other things. Because heirship certificate are generally given under local state law

Take for eg Maharashtra ( I take this state because I have studied this state law , Other state law may be slightly different )

In Maharashtra Bombay regulation 1827 deals with heirship certificate from court . Since it is received from court under Specific act it is given more imp.

Second one certificate is given in Maharashtra from thasildar under some GR and that can be used to claim pension from govt , it is not given to others but govt employee legal heir still it can have weitage

Third all Dept function under specific act , they have provision to update name after death to successor as procedure like giving affidavit , I indemnity bond , filling form . This procedure is adopted in places like land records , Municipal records etc

Now in your state what your state laws state required to be checked and followed you can not adopt one state law in other although 90 per cent are same

In most of the states, LH certificate is issued from Tehsildar office.
