Legal heir certificate

I have a property in my hometown, the asset in my grandmother's name.

My grandmother was passed away in 2004.
She has one and only daughter i. e.my mother.

She was also passed away in 2005. We got death certificate for both of them. But we could not get legal heir certificate from my grandmother to my mom or myself.

I'm also a single daughter for my mom.

Can you please advise how to approach legally to get this certificate to change that property in my name.

Approach area SDM for legal representative certificate with relevant documents.

Consult and engage a local prudent lawyer for proper appreciation of facts & documents, analyse, guide and proceed.

Actually my native is trichy in tamilnadu. I have consulted a lawyer regarding this issue. He asked to get NOC from taluk office hence I have approached taluk office,VAO and RI with relevant documents which they required. But they are getting fear to produce this NOC. I have struggled a lot of times but no use of it. Could please advise how to progress further.

You should apply for Legal Heir certificate in the place where the concerned party passed away.There is no such thing as NOC in this matter.Meet the Officials in Tehsildar office where the person passed away resided.Advocates have nothing to do with this and it is only following the procedures and complying the formalities.

Still if you have Problem send a Registered letter thro RTI affixing Rs 10/- Court Stamp stating all details with evidence in Xerox and with in 30 days you would be replied and comply with that.

your lawyer has guided you properly, should proceed accordingly. Discuss with him in case of any procedural difficulty.

I agree with the suggestion of Dr.Vashista. I suggest you approach the VAO who can facilitate issue of legal heir certificate from Tahsildar/authorized officer from your mother to you. Then you approach for your grand mother to your mother or according to priority. You can take the services of Documentation
Centre closer to Taluk office they can guide you better as it relate to taking action as per rules against set procedure.
