Lay off from multi national company due to illness

(Querist) 25 April 2018 This query is : Resolved
Hi, I'm posting this for my friend who had some health issues and was on leave, currently the company where he is working from last 10 years is asking him to leave as there are no projects for him.
The person had undergone craniectomy both left & right brains followed by multiple bleeds in the brain due to fever and platelets going down in the month of June 2016. Once the Edema of the brain came down, cranioplasty was done in Aug 2016..but since the bone got infected we had to remove it in Feb 2017 and replaced it with mesh covering the brain last September 2017.
Meanwhile his company just paid us Rs 5 lakhs ie the insurance what the family of 5 members was eligible for. He also got the salary for June 2016 as he had leaves accumulated & as a good gesture he got salary for next two months aswell, later his company stopped paying him.

Since he was still undergoing treatment & was only bread earner for a 5 member family we needed help financially and wrote to the company requesting for help and hence they started paying him utill he joined back in Feb 2017.
When he was joining back his treating doctors spoke to his manager requesting to take it slow and give him minimal work. Now while he was there working he was also undergoing treatment and underwent a final surgery after 8months of joining back. Now the work given also was minimal. Later when it was time for a yearly rewiew of the employee he was on bench from March now they are like we don't have a suitable project for him....I guess it will be resignation next. So just need advise from experts on this regarding general policy for people who have medically gone through problems.

Tell him to meet the top management and accommodate him for some more time till he feels energized and regains his health again. In case they dint respond Issue a legal notice to them under proper acknowledgment. if they don't respond within notice period file a case before Labor commissioner to stay his forcible resignation or termination or in the alternative pay his terminal benefits.

Thank you ms.usha Kapoor, He has joined back to office and currently is healthy and fit to work. The company is saying there is no project for him and indirectly telling him to resign, which seems like in a couple of weeks they might ask him to leave.
