Land lease deed

(Querist) 19 February 2018 This query is : Resolved
Respected panel,
I have a query to clear.
I and my cousin were a partner in a firm. But due to some issue my cousin was replaced by my father. But the firm name is same. UPSIDC is asking to pay for the correction in land deed. My query is where it is given to do so. I have read the manual regarding that. Plz suggest me the solution whether we have to we can be exempted??

Solution lies in the correspondence with the UPSIDC only, not anyone else. You may ask them in writing whatever clarification you want.

Instead of manual, you are required to read conditions contained in the lease deed, itself, which can be self speaking. However, if unable to interpret the lengthy terms & conditions of the lease deed, consult some local lawyer to advise you as per the terms of lease deed.

Please note. Partnership is not an independent entity. It is only a compendium of name.
You say only two (you and your cousin) were the partners.
Once one of the partners in the Firm is replaced, then there is constitution of a new Firm (with fresh partners i.e. you and your father).
If the original land deed was in the name of you and your cousin, now that position has changed.
In that event, there is need for change in the land deed.

Show the documents to a local lawyer for better appreciation of facts, analyse and advise.
