Land division rule

Dear Madam/Sir,
We are two brothers and four sister. My father has expired in 2012. Now we want to divide the land properties. My all the sister have decided that all the land property will be divided in two brothers only. Now, I want to transfer the land in the name of two brothers. What will be the legal ways to do it. My sisters are agreed to support/compromise in court also. Please suggest

Get registered the Relinquishment deed before the local registrar.

Registered relinquishment deed is the way. Gift can be done but it may attract higher stamp duty.

In Haryana, no stamp duty is payable in blood relations.

The sisters have to relinquish their rights to share in the property by executing a registered release deed in favor of their brothers, based on which the brothers can either jointly or separately register their share of properties on their names and apply for mutation of records too on their individual names.

1. The sisters should execute and register a relinquishment deed,

2. Then the brothers can make settlement deed or partition deed duly dividing and demarcating the entire property and register the same before the Registrar.
