Judicial separation and marriage

(Querist) 12 June 2013 This query is : Resolved 
Dear Sir,
We are living separately for more than six years. wife filed a false 498a complaint four years ago, we got anticipatory bail, no FIR and further no action. She don't want to join with me, all compromises failed. I wanted to get out of this and start a new life.
I wanted your advice on how to get judicial separation and divorce. Give me idea how long it take to get divorce and the procedure.

Desertion is a good ground for div. You may add false complaint of 498a as a ground of cruelty in ur petition.

file for divorce on grounds of cruelty and desertion . since you are staying separate for more than 6 years your wife may not oppose your divorce petition

Filing 498A IPC is not a cruelty as held by Hon'ble Supreme Court of India so only ground of desertion is left with you.
