Joint ownership of our flat

(Querist) 29 June 2015 This query is : Resolved 
I and my wife purchased a government flat in my wife's name sharing the purchase amount equally. Now my wife is already trying to dominate me and this may lead to divorce.

Prior to that I want a equal ownership in the flat as both have paid equal amount while purchasing the flat.

Kindly let me know the procedure for the same.

you can re-register as co-owner. or easier would be that she executes a gift deed giving 50% of the flat ownership to you.

A flat need not be the reason for divorce. There could be other reasons. A dispassionate soul searching may provide the answer.

The flat is in the name of your wife, in case of divorce or otherwise, you can not claim any share in the flat with out her consent / wish.

When the flat was purchased ? Are you able to prove that you have paid one half of the purchase price of the flat. If the payment is within three years, you can file a suit to recover the amount paid by you. You can say that amount paid by you was a loan to your wife. She may come for settlement.

If your wife agrees, you can get 50% of the property by way of settlement.
