Joining a psu hiding the service in other psu

(Querist) 22 April 2014 This query is : Resolved
Sir,
For the last 7 years I was working in a PSU where we were working in a totally unhealthy environment.Only 5%of total employees are working in our dept.Management was rejecting our transfer requests and applications for noc to apply for other PSU jobs.
So I applied to another PSU stating that i am working in a small private firm(I can get relieval letter from this firm). I got the job and my relieval from current employer will be done with in one week and I will get the relieval letter. Since I have not mentioned about this PSU exp in application form, can I produce the relieval letter to the new PSU. If not whether any chance is there that they will find this history and terminate me from service.

It is a concealment of fact, which (on being found) shall harm you.

You have applied to the new company stating that you are employed in a pvt limited company.

Then how can you produce the relieving letter issued by the PSU.

By this you confess yourself that you have given false information in the application.

Any employer will not entertain this. You will be in problem.

When you are working in a PSU, even for applying to another PSU, you should get NOC before applying.
You have not done this.
You have given wrong information that you are working ina private company.
You are selected to another PSU.
You wish to produce the relieving certificate from the private company in which you actually never worked.
What you will do with the present employment? Will you resign? on what grounds? Will they relieve you?

You have made a wrong declaration. You have concealed with the facts. I do not believe that the present PSU is not giving NOC. You are hiding something which you do not like to disclose to new employer.

All these steps will create trouble to you in future.
Punishment depends on how the new PSU will take the misrepresentations. Normally there is no excuse for such misrepresentations.

There are no options left for you. join the new employment furnishing the relieving certificate from the present employer and hope that nothing serious would happen. Perhaps, the matter may not be of much consequence if the wrong information furnished does not have much bearing on eligibility and selection for the new job.

you have suppressed the facts and it may invite disciplinary action against you at any time in present or in new PSU.

Once committed some offence can of minor nature, but that should not become the major one by concealing facts after the facts. Don't be afraid, must present your relieving letter, if demanded by new PSU. However, action depends upon how strict is the HR department of the new PSU. The only thing you should take care is, don't join new PSU unless formally relieved by your present PSU.

As advised by experts, it is better you get properly relieved from the previous employer and join the new employer by producing the relieving letter. If the new employer enquires about your previous employer you can narrate the circumstances in writing that the previous employer refused to give NOC hence you had to state that you were employed elsewhere in private, however since you have the proper relieving letter from the previous employer, your matter may not be given a serious thought over the minor lapse.
