Is panchayat decision valid in modern cities too?

(Querist) 28 May 2016 This query is : Resolved
Warm regards to all the experts.

We live in Jodhpur, Rajasthan. We have enmity with a person over a petty issue, he can't take legal action against us because he doesn't have a valid legal case. I had confirmed with the cops (honest talk, not by bribing!), they told me to stop worrying as there is no valid case.

He MAY stand up in the panchayat against us which will be held next week. We are a modern educated family whereas he is an illiterate unemployed guy who takes afeem regularly! In short, we don't believe in panchayats but he does.

NOTE: This won't be a registered/recognized panchayat. Some rich guy will arrange this panchayat (for his own selfish reasons) and call some well-known elders to act as panchs. Other caste members have an option to go their and raise their issues simultaneously.

Hence my queries:

1. Are such panchayat decisions VALID even for cities like Jodhpur?

2. Will/Can the cops go to the panchayat to stop their nuisance? If yes, under which law/section?

Thanks in advance.

you do not believe and in panchayat and he does.

how do you think he is fool simply being illiterate.

panchayats are recognised by Constitution of India and are legal entities and decisions taken by panchayat (as long as within domain) is perfectly binding.

You are hiding what is real issue and cannot expect a solution.

Sir, I think author is talking about Panchyat which is not formed under Constitution of India . Nor under the Act

2) Panchyat which is formed under constitution can function or do work under Schedule Eleven and matters related to it.

3) This Panchyat may be illegal community panchyat which has no place in constitution of India.

4) It is just like infamous Khap Panchyat or some thing like that .

I feel better author should tell what is problem with you and khap panchyat and that person Then proper ans. can be given.

Panchayat can act on matters that are in its domain.

The author said

"He MAY stand up in the panchayat against us which will be held next week. "

SO he is talking about lawful and official panchayat and not khap panchayats

@Sudhir Kumar
Sir you are so knowledgeable and intelligent YET you failed to read the NOTE in my query!

Expert Madhuji has correctly mentioned that it is similar to a khap panchayat.

AGAIN: A rich snob will arrange for a panchayat for our community for his own selfish reasons. He will call RANDOM ELDERS to act as panch. They will have no constitutional recognition whatsoever.

REAL MATTER is not worth discussing here. Local lawyers and police had already told me that there is no legal matter/case here and to stop worrying.

Now, please please tell me whether I can take any PREVENTIVE ACTION with the help of police or lawyers?

It's not like I am afraid of the panchayat's decisions! I want to teach them a lesson IN CASE they try to interfere in my personal matters!

Thanks in advance.

No one likes others interfere in their matter.

Now this so called Parallel Judiciary (It exist all over India, in one form or another) problem is that they have their own vested interest.

Some parallel judiciary is controlled by some community leader, some by criminal , some by political parties, etc.

Better don't go to them or heed them from day 1 , then they know no one bothers about them. After this they take some step (Allow them to do mistake within frame work of criminal law) once they do some thing illegal then only legal steps can be taken ,

Just imaginary things have no place
