(Querist) 26 August 2016 This query is : Resolved
Sir..
My father and mother made agreement with first owner of house... who had got the house from mhada on lottry basis... 1987 made agreement that such person has no ability to pay the installment of mhada and he giving the possession of the same property to our mother... And he has given us all documents regarding the same... From 1987 our mother has paid all installment and we got letter from mhada in 1994...that the senior of mhada has given the permission regarding the allotment of the house in the name of our mother and pay some last dues and u will get the allotment letter for the same.... So my question is... What should I do for registration of my mother name on property card... Is the allotment letter from mhada is sufficient for the same...

Is there any need to pay stamp duty... Pls u knows then reply me... I will be thankful to you...

Mahda will execute sale deed of the property in favor of the Cooperative housing society of all the allottees in which ur mother will be included as Member. your mother may have to register the allotment letter and pay stamp duty on it.u may however verify this with MAHDA However if the flat is allotted on tenancy basis Mahda executes tenancy agreement which will have to be registered.

Allotment letter,Lease and sale agreement.Tenency agreement wil not substitute the Sale deed. The Sale deed to be executed in favour of the allotte free of cost since Cooperative Societies are exempted from Registration fees. This the system in force at Tamilnadu State. It may vary from state to state, but sale deed is to be given for the clear title.
