Ipc 279 and ipc 176 and govt job

(Querist) 26 May 2015 This query is : Resolved
I was once charged under IPC 279 and IPC 176 and took me five years to be acquitted from all charges..
now I have been selected in govt bank job will this create any problem in my selection ?
the employer asked me to give reference of two referees in which they asking whether candidate even been convicted/prosecuted/arrested..where my referees don't know about my case they have marked 'NO' in that field..will this create any problem for me or my referees ??
Dr J C Vashista (Expert) 27 May 2015
No problem will be there, if you have been acquitted.
adhar (Querist) 27 May 2015
Thanks for your response sir...
Sir as I have mentioned my employer sent mail to two of my refrees for any antecedent and criminal record..there was one question
"to the best of your knowledge whether candidate has ever been convicted/prosecuted/arrested? "

As my refrees din know about my accident and case they have marked 'NO' in that particular question...

I am concerned for them as they both are govt employees..will this create any problem to my refrees and as well me..please give me appropriate suggestion Sir.
Devajyoti Barman (Expert) 27 May 2015
No, it will not create any problem.
adhar (Querist) 27 May 2015
thank you so much experts..
just one last question and doubt in my mind...
It won't affect my referees right ?

Sudhir Kumar, Advocate (Expert) 28 May 2015
You are silent as to whether you yourself have reported this case or not.

False information given in attestation form can lead trouble for your refree as Govt servant.
adhar (Querist) 28 May 2015
In attestation form which I had to fill..there was no question related to prosecution only conviction and pending cases were have to mentioned...
and my referees just have to fill reference report
and I am only worried because I am prosecuted once but now I am acquitted...
still it will create any problem to my referees ??

If there was no declaration to be made by you as per form and your post and referees are indeed not aware then Mr.Barman and Dr.Vashista have already answered.
Kumar Doab (Expert) 28 May 2015
What is the need to repeat!

The query is same.
adhar (Querist) 28 May 2015
Thank you so much Kumar Daob sir..
thats a relief...
m happy now that my referees are safe..thanks again for your positive response ☺
Sudhir Kumar, Advocate (Expert) 29 May 2015
Even if no declaration is made by you the police is bound to report the truth.

Deptt has a right to know details of the case even if you are acquitted.
adhar (Querist) 29 May 2015
Means it will create problem for my referees ?
Sir they did ask about conviction/ fine/ arrest/bound down and pending case only in attestation form but not about any prosecution..so I did not mention about my case as I am acquitted now...
And also in reference report from referess the question they ask
to the best of your knowledge..has he ever been prosecuted/arrested/convicted..so as they dnt know about the case they marked 'NO'
I hope nothing turns around against me and my referees.
and thank you all for all the suggestions.
T. Kalaiselvan, Advocate (Expert) 01 June 2015
You may worry about yourself alone and not the referees. They are bound by their version of remarks on you and in case of any issue over their recommendation in the future, they know how to defend themselves. In fact since you have been already acquitted, you need not worry much about the issue.
