Guest (Querist) 21 February 2017 This query is : Resolved
Dear Experts,

I have constructed a house in house site which is belongs to joint family,me my brother having equal rights on the said house site.i have constructed the house at one side of the house site and my house is occupied 40% of the house site, and 60% of the remaining house site is still vacant.so i asked my brother to take the half of the vacant house site for his share.but he is demanding the half share in the house constructed by me and half share from the remaining vacant site and trying to enter into my house.

I have electricity service with my name for that above said house and i have electricity bill paid receipts with me and also i have house tax paid bills and bills paid for water, with these house tax paid bills and electricity bills can i get injection on my brother from court?

please suggest me how to retain my house in this case

Note: My brother is filed a partition suite to get his half share from the total house site but he did not mentioned that the house constructed by me in the partition suite.

While filing your say before the court, mention everything in detail as mentioned. The court shall decide accordingly. Appoint a good lawyer.

Prove the fact that you have constructed the house from your own resources with the verbal consent of your brother. Submit proofs of your construction cost.

Construction of the House with out Partition will not be in your Favor.Having the Name in Electricity Card will not get you any Title and Even a Tenant Could get it.If at all you had Paid any House Tax it would have been Supportive.Though the Matter is in Court you could Try for an amicable solution after all he is your brother.
