I want to tranfer share of 50% to my mother on my deceased father name

sir. we have house property on 50 -50 on my father name and elder brother. now my father died living behind no will. no nomination were made.. does it automatically tranferred 50% of my father on my mother name. or any procedure.

All ClassI legal heirs of your i.e. Mother, Wife, sons, daughters…………………shall have equal share in it.

It is simple case of inheritance and obtain requisite forms/procedure from O/o Authority under whose jurisdiction property falls and submit requisite docs e.g; death certificate, legal heir certificate etc and obtain copy of latest mutation record showing ownership transferred on the basis of inheritance in names of all ClassI legal heirs.
Per local procedure the authority may agree to transfer in the name of Mother on the basis of NOC or may ask to go for valid and registered:
relinquishment/gift/sale deed etc…in favor of Mother.
A valid deed is better than mere NOC.
Thereafter obtain latest mutation record showing title in the name of mother.

my elder brother has 50% share in it.. what about his share.. whether this share also be equally distributed among class 1 legel heir.
