Husband wife not living together. can this be base for divorce

(Querist) 04 September 2015 This query is : Resolved
Hello,

Married in Mar 2009
Separated in Nov 2010
Sec-9 R2R,Sec-24 HMA filed by wife
in response I clearly denied for R2R.

S-125 crpc filed by wife in Feb 2013.

court rejected the application filed by wife on Dec 2014.

total period of not living together
Nov 2010 to till date i.e. 4 Years and 10 Months.

Can this be base for divorce?

Reasons for court rejecting s-125?

Opt for MCD which will not be difficult if both agree.
Bhuvan (Querist) 05 September 2015
Thanks Sainath for your reply.

According to court, she is able to maintain herself, that is why S 125 was rejected.

regarding MCD, they are asking for money, which is very high as compared to what they actually spent on marriage.

I am the only son and because of all this i am not able to raise my offspring.

This is what my in-laws want.

that is why i am not looking for MCD.

so can "not living together for this much time" be ground for divorce.

Can U elaborate?

why you were living apart how things went so bad.
Bhuvan (Querist) 07 September 2015
Hello Sainath sir,

I want to say following in "I am the only son and because of this i am not able to raise my offspring"

I have no brother and hence i am the only Son.

and without divorce i cannot do second marriage, and with the present wife one i don't want to live.

so all this means that my family tree will stop at my stage.

Hello Sudhir sir,

Answer to your query is a LONG story.

without facts you cannot be advised. You are simply saying that you do not want to live with her. that does not describe any problem.
