How to prove that my grandfather was a farmer.

(Querist) 22 October 2014 This query is : Resolved
Hi, i am looking to purchase an agriculture land in mandya, karnataka. i am working for a private company since 3 years and my salary is around 2 lakhs per annum. i have not filed IT even once till now as my salary is less. since in karnataka there is a law that only agriculturists can purchase farm land, my question to you is 1. how do i prove that my grandfather was a farmer? my maternal grandfather is passed away and he owned some agri land which was sold a decade ago.

Why do you want to prove your grandfather as farmer? is it enough as your status as farmer required. Your grandfather's status as farmer may not be sufficient.

thanks for immediate reply. let me clarify. i am not an agriculturist and even my parents were not agriculturists. and i don't have any land in my name or in my parents name. i am now looking to purchase a land and i am confused about the law in karnataka that only agriculturists can purchase agri land since my annual income is around 2 lakh.

I do not think you are fit to buy it.
However since it involves local law , you better consult someone hailing from Karnataka,

As per Karnataka Land Reforms Act, if any one who is not from Agriculture background wants to buy an agriculture [Wet/Dry] land can approach the D.C for their intention to become agriculturist. If they fullfill the requirements [Documents, Intention to become Agriculturist etc.,] then D.C will give permission to buy A, B or C Class Agriculture Land. This rule will not applicable for buying Plantation Crops i.e., Coffee, Tea, Rubber, Pepper, Cardamom etc., The land having plantation crops does not comes under ceiling limits(section 63 & 64), that land has no application of section 79A and 79B of land reforms act. That is even non agriculturist or any one can buy land having plantations crop.

I thank all for your opinion.
I am very much pained because of this stupid law even though i do respect the law of the land. i will tell you why i feel it is stupid, (if you are not interested in reading my story, you may skip to the last 2 paragraphs)
I just want to tell everyone here that I am tired of being in the concrete city and working for some stupid companies who treat people like daily wagers but under 10 storey building working in Air conditioned office, i don't want to live this fake life so i intend to become a farmer and i want to start with sheep farming by purchasing 1 acre of land.

interestingly, the land that i am looking to purchase has not been cultivated for over a decade even though the person is a farmer living in the village about 1 km from his house. If you are aware, many educated people are going back to farming and you might also know that not many youngsters live in the villages today as they are working in bangalore and living a fake life. Today's villages look like old age home.

it is not that i am purchasing this land to get it converted to sites to make money. agriculture is not new to me, our family used to own a cow, a buffalo and few sheep during our childhood.

I want to believe, there will be some rules that will permit me to purchase the land. I just need some help from you expert lawyers. i went through THE KARNATAKA LAND REFORMS ACT and noticed the below,
(ii) a person or a family or a joint family shall be deemed to have an assured annual income of not less than rupees two lakhs from sources other than agricultural land on any day if such person or family or joint family had an average annual income of not less than rupees two lakhs from such sources during a period of five consecutive years preceding such day.

interestingly, i am a 30 year old and i am working only from 3 years, and i earned less than 2 lakh in the first 2 years. so does this rule allow me to buy land? if yes, what docs should i produce to prove that?
please help me out as i am planning to start a noble thing called farming.

I also want to let you all know that the land in consideration is a dry land not having any irrigation facilities from a Government source.
