How to file name change in court?

Guest (Querist) 21 May 2015 This query is : Resolved
Respected Sir,

My name is Samrath Gupta residing from Varanasi (UP)

I've changed my name from " Shivam Gupta " TO " Samrath Gupta ".

I wanted to change my name in my marksheets of Highschool and Inter.

I've submitted all the things required by CBSE Board. When I called them to ask about my case they said my case got rejected.

When I asked for reason they said new laws have come from CBSE board

I've these records with me:

1- Govt Gazette
2- Publications in news paper
3- Affidavit
4- Affidavit sworn before Magistrate (PhotoCopy)

How can I move forward?

Answer is there in the last para of the Circular. You will have to obtain a Court Order for name/surname correction as per Official Order of CBSE. As you have completed all other formalities, file a suit for declaration and obtain the court order and then submit the court order to CBSE for name correction.

Sir - I understood that part but I'm not able to understand that How can I obtain court order? What is the procedure?

How much time it takes to get order from the court?

You have to file a declaratory suit seeking the court to declare your proposed name as your name henceforth to be called as. You have to consult a lawyer and proceed as per his further advise.
