House registration procedure

Hi Friends

i have a query

our house is in the name of my grandmother. she expired two years ago.my grandfather is also no more.

they had two children i.e my father and my aunt(buaa). my father expired one year ago.

so i want to know what is the procedure to get this house registered in the name of my mother.we are three children (one is minor). my aunt i.e buaa ji has no objection regarding that.

house is self earned by my grandfather. purchased in 1991 and during there is no sale purchase. so plz tell me what is the procedure....sorry for my bad english....

you and your brothers including minor (minor represented by guardian) and your aunt may execute a gift deed in favour of your mother. consult a local lawyer and show him the document of your grandpa and get the deed drafted.

Agree with the expert's opinion. Get a gift deed executed in favor of ur mother as suggested and register the same.

Thanku sir ...i googled your answer and found thatminor cant be a donor ,.... he can only be a donee(represented by gurdian). Or there is any other provision?

You may consult your local lawyer if a relinquishment deed from your Buaji could be better and cost effective mode for mutation in the name of your mother with NOC / relinquishment from all the children too

Reg gift by minor- I agree minor's share cannot be gifted as he is incompetent to enter into a contract.
