1. File another case for maintenance and provision for housing under OWDV Act. Here decision comes fast.
2. The FIR needs to be seen for this.You can file Criminal Revision , not writ petition.
3.Getting divorce is not easy unless both of you so agree. So ask him to give you divorce if you waive your right for maintenance.

1. Yes, the legal opinion of the A.P.P is a flaw and for this purpose file a writ before Honb'e H.C. challenging the deletion of s. 376-A I.P.C.

2. The maintenance case u/s 125 Cr.P.C. should be attended on priority by your advocate.

3. If he agreeing for divorce by mutual consent then proceed to file such petition. Or even other wise you can file petition for divorce on grounds of mental cruelty.

This is a clear issue of domestic violence, you may move an application under this act seeking reliefs as provided in the act.

Every act of violence invokes afresh cause of action for domestic violence. No time limit as such.

If you are still below 28 you can get a public sector employment o rat least a teacher post after doing BEd in Government Schools and support yourself your dignity and self respect are offended it is a criminal waste to stay in a non compatible and loveless marriage.Write DSc exam and get succeeded for a government teacher's post under Reserved quota.
