Heirship or succession

(Querist) 30 July 2015 This query is : Resolved
I am the only child in my family and my parents passed away few years back.

I possess a property at Chembur, Mumbai and the property is worth 1.5 crore.

The property is 50% in my name and the rest 50% in my mother's name.

What shall I do? Shall I apply for Heirship or Succession Certificate?

If Heirship, where? and if Succession Certificate, where?

I believe these two have different meanings in law and I would like to know which would apply to my case?

Regards
Raju

yes. without getting succession certificate or legal heir certificate you can not alienate the entire property.

in addition you may consult local advocate for further guidance.

Consult local lawyer, he would guide regarding procedure and situation of local office to get the certificates.

HI
You should get a legal heir certificate from Mandal revenue office.
Also you can apply for succession certificate in the court having jurisdiction (to the place where you live)

You can transfer the property in your name at the sub registrar office by submitting the legal heir certificate / succession certificate.

If it is a Co -Op society property then check the rules from society office and website of Registrar of societies.

You may also check if Nomination was made by mother for her share.....................and If any valid WILL was also left by your mother.

If your father is also not alive you are the only heir and hence must not face any difficulty.

A local lawyer dealing in revenue/family/civil/property matters can advise you, after examining all docs on record.
