If previously fractured leg again got fractured by hockey stick in quarrel then it comes U/s 325 or Not. Please guide.

I am from accused side but yes the complainant had iron rod placed on his leg before this incident. Please guide which defence available for accused.

Thanks a ton for all. Is there any defence available in favour of accused. Complaint got registered after 24 days after the incident & Complainant got leg fractured at that incident & he is claiming 5 lac before mediation to settle the case. Please guide!
