Gratuity on resignation

I have put 10 years of service in CPF scheme in an Indian Institute of Technology. I am shifting to another institute. Can I get gratuity in case my Technical resignation is not accepted and it is accepted only as normal resignation from service?

Neverthless you are eligible for terminal benefits for the service rendered.

I profusely thank Mr. Isaac Gabriel and Dr. J.C. Vashista for sparing valuable time. I am told by my organization that I will get only leave encashment and not gratuity, in case my resignation is not accepted as technical resignation. They are giving example of one employee who served for 19 years, joined a private company on resignation and was denied gratuity. I request for your suggestion, what should I do in case I am denied gratuity. I am in CPF scheme.

Doubtlessly, you are eligible for gratuity. You may apply for the same on the prescribed Form-I. If formally refused, you can represent to the prescribed competent authority, as appointed by the Government.
