Gratuity eligibility in india

I have joined 16 Aug 2010 & resigned 05 June 2015. Please tell me I am eligible for gratuity or not.
& working days are 6-days in a week. please help me. for gratuity eligibility & I need to claim. whether any last date for claiming the gratuity.

Have you been or are you a member of Employee's/Trade Unions?

The united members are properly informed.

Count from DOJ to LWD.
Year 2012 was a leap year.

Payment of Gratuity Act;Sec2A

If you have worked for 240 days in 5th year, you are eligible.

Employer on its own has to tender payment of Gratuity within 30 days from LWD or shall have to tender interest @10%pa.



Anyone who avoids to pay Gratuity can be punished and penalized with jail time as per Sec:9.





There is no wage ceiling on Gratuity and limitation.


However there is no point in delaying.


You may submit FormI under proper acknowledgment.

Submit your form for claim gratuity and in case of denial consult local lawyer.
