Gratuity

My father retired from U.P Jal Nigam in 2008.Due to his prolonged illness he could not get his gratuity released and expired last year. Can I get his gratuity released now?
Also tell what sum of gratuity will be due to him and will it be governed by 6th pay commission?

1)Yes, if U R the nominee.
2)Depends on his last drawn salary & the No. of years of service. Also, the amount is usually subject to a max. ceiling.

First of all determine the Gratuity Rules applicable to the establishment and obtain a copy.

The nominee can stake the claim and usually the employer get the nomination recorded.

If you are the nominee you can or follow the procedure to stake the claim if nomination is not recorded.

The employer and Gratuity Rules shall clarify the amount payable.

Download from website of the establishment or obtain and inquire from office/employee's union leaders, colleagues of father..........google etc

The problem does not seem to be your real problem. The query is of academic nature more so when you are pertinent to know about the implication of any pay commission recommendations. Secondly, I have not seen any emply not to care for release of retirement gratuity for altogether even after elapse of 7 years of retirement.

If it is your real problem and were a nominee for gratuity, you could well have lodged your claim to the Jal Nigam, not asked for application 6th pay commission. The Jal Nigam should not have been expected to be ignorant of rules of pay fixation and calcualtion of emoluments for the purpose of working out the amount of gratuity permissible to your father. You won't be required to teach them.
