Giving property on rent

I HAVE TWO FLAT LYING VACANT IN MY POSSESSION IN KOLKATA ,NOW I INTEND TO GIVE THE SAME ON RENT.THE PERSON TAKING ON RENT IS SAYING THAT HE SHALL UTILIZE THIS FLAT AS PAYING GUEST ACCOMMODATION.?

MY QUERY IS:
1.: WHAT IS MY LIABILITY IF A PERSON TAKING MY FLAT ON RENT USE PROPERTY AS PG ACCOMMODATION ?
2.: IN RENT AGREEMENT SHOULD I MENTION THAT PERSON TAKING RENT FOR PG OR NOT?
3.:FOR HOW MANY YEARS/MONTH SHOULD I DO RENT AGREEMENT ?
4.:ANY PRECAUTION ADVISED FOR GIVING PROPERTY ON RENT SO THAT PERSON TAKING PROPERTY ON RENT DOES NOT CLAIM HIS RIGHT IN YEARS TO COME.

You must verify about the tenant from police station and or submit his full information to the nearest police station.

You must mention about nature of tenancy.

it is depend on you there is no any hard and fast rule.

Whether any such activity/ commercial activity is permissible in the area?

Police verification and other formalities/ licenses need to be taken before starting the activity.

1. You are required to execute a registered Lease & Licence deed for commercial purpose intimating the Municipal authorities, police authorities, electricity and water supplying and sewage disposal agency so that the tenant may be charged with commercial rate and examine other factors involved including procurement of licence where necessary e.g. if the tenant intends to providing food to his tenants in PG etc. etc.
2. The period of tenancy, rate of rent, amount of security deposit, notice of vacation/eviction etc. for such agreement, is to be decided between you and the your tenant, at the initial stage itself.
3. Since it involves many legal issues which are to be taken care, it would be appropriate and advised to consult and engage a local lawyer for seeking professional service, in your own interest and benefit.
