Get remedy under two act simultaneously

Dear sir
Some one fraudulently transfer money from my bank account. May i get remedy in Consumer protection act as well as information technology act simultaneously? As cause of action triggered under both the act.

You can file criminal complaint and file consumer complaint.

I hope it is a real story and not an academic debatable topic or mute court subject?
If so, you have to choose either of the options to move under consumer protection act or information and technology act.

While in consumer protection act you will be compensated for your losses by the bank provided you prove the deficiency on the part of the bank, in Information Technology Act the offender will be punished. I am afraid and it looks doubtful that I.T.Act will compensate you. However, if the offender is caught and recovery of the amount fraudulently taken out of your bank account is made then there may be some relief.
