Framing of charges

(Querist) 04 April 2019 This query is : Resolved
Sir,
In a private criminal case, Trial Court's order of framing of charges is an interlocutory order or not?
The accused went to Dist Court challenging the order.
Thanks and Regards.
Dr J C Vashista (Expert) 05 April 2019
It is not an interlocutory order.
N.K.Assumi (Expert) 05 April 2019
I agree with expert Dr.J.C.Vashista. In criminal trial all kinds of orders like summon, adjournments or bail etc, are interlocutory orders, but orders which substantially affects the rights of the accused or decides certain rights of the parties cannot be said to be an interlocutory orders.
