Forwarded official documents to personal email

I was working with an organisation and at the time of leaving the organisation, I forwarded few official documents like audit report, pollution clearance certificates, copy of invoices etc etc from my official email id to personal email id. Now after few days, company has filed a complain with crime branch that I have taken confidential information.

I have not used these information anywhere and it was for my personal knowledge updates.

Now how shall i come out of this mess?

You may have to defend your criminal case effectively. So, don't delay to hire some capable lawyer in criminal law at local level.

As the criminal action has yet to be initiated and you have just been intimated about the intention of the company so it shall be better to use old relations and settle the issue with the company by putting your written clarification. Engage lawyer only if all such efforts get failed and criminal case is filed against you.

You have not disclosed if you have already tried Or if company has already contacted you for some kind of amicable settlement/recourse.



If all efforts have failed then the approach of the company may be firm and determined.


Employees are usually not well versed in service /criminal matters.


Whatever you may say or you may write may become a case record/document.



It shall be better to consult well in time and in advance.


If charges are proved the consequences may be penultimate.



If you are confident that you are well informed and can handle the matter on your own then you may.

Company informed me over email that they will file FIR aainst me for forwarding emails from official email id to personal email id. but I didnt responded because I got afraid of all this.

After few days, company filed complaint against me with local crime branch.

I have written apology letter to company and also requested them to withraw the complaint. I have telephonically spoken to HR head but till date I have not received any reply frrom company end.

This was the time you should have consulted your counsel.

The company might have not asked you to apologize in its email.


The company might have stated in its email that if you apologize then it won't file any complaint.


Had you consulted your counsel could have opined and structured your reply.



Now what exactly do you want; reply from company in response to your apology and phone call to HR?



Since there is NO reply in response to your apology and phone call to HR; better take elders of your family in confidence and approach a very able counsel and defend your interest.

If department has not responded against your apology letter and even no police action is heard, there is no need to hurry or worry. Wait and watch now and if possible personally meet the company officials and apprise them your situation and pray not to move ahead.

You have on your own sent written apology.

Despite the apology, you have come to know about police complaint ( from your own sources, HR, or police etc) and may be police has called you.



Now if possible, and/or if you want to try the appeal and pray to call back the police complaint, try it.




If your elders, community leaders, etc can mediate and help for amicable compromise and thus to take back the police complaint, then you may agree to delete the emails/docs and minute it in compromise.



Your own counsel can help to draft such compromise.



My hunch is that company may not agree for it until or unless it is convinced by someone other than you.



Hope you can understand.


In any case prefer legal opinion from your own counsel, before you proceed.
