Forced to resign

There has been politics going on in my office and I have been graded a rating which the company says that I may have to resign.

Let me know if there is a Labour law to protect this

I have been working since 18 years in the IT dept of this company

It all started with not getting along with my ex boss and I have not been promoted since 8 years because of the wrong impression he created with the management.


I have proved my efficiency by the current boss although not so harsh has been sidelining me since 4 years as well saying that I do not perform when I have.

Whether the company is public sector or private?

What type / in which capacity were you working whether in management cadre or otherwise?

Have they asked to resign?

Have they issued any letter regarding your low performance / grading?

Discuss with local service matters expert.

Do you have any irrefutable evidence that you were asked to resign (audio/visual/minuted/witnessed)......................and that you have been discriminated/vindicated.............and wrong ratings have been given in appraisal?

The company is a private sector

I am working in the middle management level as a Senior Manager

Only verbally but no time line specified

Yes they have issued an email regarding the grading but a general template .

I proved to them that I have saved 26 lacs for the company and given all timely deliverables

Yes enough email evidence of wrong rating given by on request they have not revised the rating

They are silent since my mom was undergoing heart surgery and said I can take some more time

If your nature of duties and real duties performed on record have powers say: to sanction (not just recommend) leave/increment/appoint/terminate etc then you may not be covered by labor laws .........................



OR even at so called senior position you may.............. have coverage.

So it is not wise to ignore whistling winds!


All said and done, you may have to prove that NO proper opportunity and natural justice was provided.


You are a marked person: not promoted and stagnating since 8 years and not comfortable with bosses.

Why don't you improve and slip away from below the axe?
