IN THIS CASE PLAINTIFF HAD GOT PRIMILARLIY DECREE IN DISSOLUTION OF PARTNERSHIP FIRM AND ACCOUNT SETTLEMENT OF SHARE IN FIRM . FOR THAT THEY APPOINTED COMMISSIONER TO VERIFY THE ACCOUNTS OF FIRM .BUT PROBLEM IS THAT DEFENDANT SIDE NOT GIVEN PROPER BOOKS OF ACCOUNTS OF FIRM THEM .IN THIS SITUATION HOW A PLAINTIFF TO GET JUDGEMENT & SHARE PLZ TELL ME ITS VERY URGENT

Once the commission is appointed, within the given time commissioner has file his report to the court, basing on the commissioner's report court will proceed further.
Here in this case as the defendants not given the proper books of accounts, then at the time of inquiry, you can insist for the incorporation of the fact that the defendants are not cooperating to submit the books and to finalise the report. And the same may help you while consideration of the final decree by making a negative observation against the defendants for the avoidance the material facts.

Commissioner may submit the report mentioning non cooperation of the defendant. You can submit your claim and let the court arrive at some conclusion.
