A and B are in a contract that A will supply exhausts for two wheelers to B for an entire year at a particular price which is lower than the general market price.
in the initial few months the exhausts supplied are good, but as time goes by the quality starts reducing to such an extent that 30% of the supplies are of extremely poor quality that they cannot be sold.
B who is a very well known trader for quality exhausts sees a direct effect on sales as well as his reputation.
B wants to file a case against A for criminal breach of trust and defamation for harming the reputation of B in the market
B does not want to take the civil route as he works on credit and payment has not been made to A and all the poor quality material has been returned back.

There is no question of defamation when the goods supplied are inferior and not acceptable.
Criminal breach of trust is for what? If at all there was a written contract in which proper specifications were there about the standard of the products to be supplied and there was any deficiency in the same or the conditions have been violated or the contract was breached, then the civil remedy is the best option, by lodging a criminal complaint he may not be able to recover the fiscal loss or loss to his reputation.
