False dowry case 2014

Guest (Querist) 25 April 2014 This query is : Resolved
i married my wife in aug 2013. things have never been good between us. since dec i have been talking to her about divorce. in april, she and her family have started linking me to my old girlfriend and is saying i have been having an affair with her. the truth is that the old girl and i are not having an affair and she is a friend who has helped me out when i was in need of help. as a revenge, now my wife's family has filed a false dowry case on me and my family. i have aged parents. we have not taken dowry. how do i go aboout this? is it possible for me to divorce her? how do i prove that the case is false and that i have not asked for or taken dowry. my whole life depends on this. im in dire need of help. any suggestion would be extremely helpful... please advice.

no facts are given.

Please bring out how things went bad.

YPu need not prove your innocence. In criminal prosecution they will have tp prove your guilt.

FIRST TAKE BAIL AND THEN FIGHT THE CASE ON MERIT. IF CASE IS FALSE THEN ACQUITTAL IS A FORGONE CONCLUSION.

What made you to talk about divorce within 4 months of the marriage? How the matter of your good friend - either you have affair or not - came into picture? 4 months not sufficient for any girl to settle down in a different home. You are not giving full facts. Any advice not basing on full facts is half-baked broth. Please come with full facts if you really wish to have advice.

fight case on merits . your wife will have to prove her allegations

Take bail first and defend yourself on merits.

If false, defend strongly with the help of some very competent advocate.

first get yourself enlarged on bail against the arrest in the criminal cases filed against you, then defend the same with the help of merits on your side and then think about divorcing her if need be or depending upon the situations.

Burden of proving the allegations lies upon the prosecution so don't worry fight out the case by engaging an expert lawyer.
