totally false fabricated case..

when should we go for quash?
Guest (Expert) 17 April 2015
When you believe to be false and are able to prove falseness of the case, you can go any time for quash.
Sudhir Kumar, Advocate (Expert) 17 April 2015
how can you be advised without knowing the facts.

based n these facts you can only be advised to contact a lawyer, pay his fee and file application in High Court.
Rajendra K Goyal (Expert) 18 April 2015
Consult senior local lawyer and show him full case file.
Devajyoti Barman (Expert) 18 April 2015
Mere falsity of a case is no ground for quashing unless the same is apparent on the face of the record.
Without knowing the case history it is difficult to advise.

thanks everyone..

if you have proof that these allegations are fake then immediately file a quashing petition before High Court otherwise wait and watch after getting bail or stay of arrest order till the filing of charge sheet and after that fight the case on merit.
Dr J C Vashista (Expert) 18 April 2015
How did you come to know and drawn the inference that the cases are false and fabricated???
If you have sufficient evidence, move straight away for quashing.

my friends family members got anticipatory bail with no time limit only male persons hv to appear once per month upto char sheet filed by police Investigating PI..... but police is asking to arrest ( suurrender) for 1 hr and then will release on jamin.. is it possible???.. why police want to arrest as already anticipatory bail is there?.

should they arrest? no any evidence against all of them, with false fabricated FIR 498.. should we follow police?
our lawyer is also asking for arrest telling that you should not go for anti cipatory bail, now you got and have to arrest with taking photographs in police staion with name follow arrest procedure and then produce jamin. etc..

they all already appear in police station and gave staements..

My friends' statement is due.. as he didnt got anticipatory bail.. going AB or regular bail as they are so much confused..please guide.

any time limit between after getting property valuation report( solvancY) for jamin and apeearance of jamin in front of police? as all his family members got solvancy for jamin ..

In total there is 1 user chatting based on users active over the past 5 minutes
T. Kalaiselvan, Advocate (Expert) 25 April 2015
You must see the conditions imposed in the anticipatory bail, if the condition is that you have to surrender before the police for regular bail, the conditions to be complied with or else the AB will be cancelled.
