FIR registration

(Querist) 09 April 2009 This query is : Resolved
Ld counsels,

What should be mentioned in the FIR when there was a related complaint filed by the father of the complainant and the same was withdrawn.

Can this be called first information. There is a one month gap between the first complaint that was withdrawn and the second one.

Also kindly clarify if I need the certified copies of the first complaint and statement that was withdrawn for filing quash petion on the second complaint/FIR. There are contradiction between the first complaint and the second compliant in the allegations.

Please clarify. Thanks.

FIR is just an initiation of criminal proceedings. You state your complaint to police.

Delay in registering FIR for such a long period is fatal to the prosecution case, and the Court look with suspicion of such FIR as after thought or manufactured accusation.

FIR is just initiation of criminal proceedings as rightly said by Mr. Suresh. You need the certified copies of the first complaint and statement that was withdrawn for filing quash petition on the second complaint/FIR, to substantiate the contradictions.

In the F.I.R. you must mention date and time of incedent and also name of witness, who saw the incedent.Full detail of incedent, names addresses of the accused if possible.you must know that in general police does not register F.i.R. If police lodge First information report it must be written in the FIR register and at the same time a duplicate copy of the same from the FIR register will be given to you by the police.FIR must be lodged immedialy after the incedent.
