Execution application in Consumer Forum

Sir in a execution application being filed by us in consumer forum for executing the award of amount being passed in favour of us,the Forum has asked us to file the list of properties in the name of J.D but we have no knowledge about the same despite our best efforts and on the next date what step we should take to secure our ends ?

Pls ask the court to appoint a Local Commissioner who would go to the judgment debtor and prepare a list of assets, and then submit to the court the list of assets with value thereof for attachment and sale to recover the amount decreed in your favour.

If it is not possible for you to search the details of property of opposite party, then withdraw the present execution petition from forum with liberty to file fresh petition u/s 27 of C.P.Act and prey therein to pass an order for three years imprisonment and fine of Rs 10000/-to opposite party for disobeying order/decision of forum.
