Exection of order under consumer protection act

I am the Plaintiff. My complaint was allowed in State Commission. As per the order given the defendant (builder) has to provide me with an alternate flat or Rs.40 lac within 3 months of the order. The term of three months have expired. The defendant has not made an appeal to National commission. I have been adviced to apply for exection of order under sec 25 and 26 of consumer protection act.
My questions are
1) What are the steps involved in execution proceedings.
2) How long does it usually take in such situition for the plaintiff to be granted remedy,where the defendant is not ready to comply with the order of State commission.
3) Section 25(3) says that The state commission may issue a certificate for the said amount to the Collector of the district (by whatever name called) and the Collector shall proceed to recover the amount in the same manner as arrears of land revenue.]. So for the recovery of the same, another civil suit will be instituted?

You have to First File the Execution Petition of the Order. The other side would be levied with Penalty or even be jailed for disobeying the order. Better discuss with your Advocate in detail and proceed.

The OP and counsels of OP are usually aware the implications of disobeying the order and may come and stand before court/commission. The court/commission are usually not lenient and to offenders that disobey and cause contempt.

File the EP. The law will take its course. There is no need at all file a civil suit.
