Evidence in civil suit by defendant

I am fighting my matter in person Bombay high Court Original side suit no. 527 of 2005
along with my employer my union is also Defendant in my suit.

My Union had already filed many affidavits in my support with supporting documents.

But now probably under fear / pressure from other Defendants may be my employer, they have not filed affidavit of evidence nor gave any evidence.

Questions:
i. will their affidavits will be helpful to me during trial of my matter ?

ii. what action I should take ?

Dear Capt. Sukhdev Singh,

1. You have filed all the necessary evidences along with your counter written statement.

2. It is not mandatory for the defendants (i.e.your employer) to file affidavit for their evidence in counter to yours until the trial commences and they depose their examination in chief.

3. You need to have a fairly good information as of the procedural laws.

4. If need be for such orientation of procedural laws you can consider to have a phone consultation with me provided that you agree to remunerate a moderate sum of Rs. 350.00 for such purpose.

Both of your questions do not bear any relevance in the absence of sufficient bckground and nature of the case to help form any specific opinion. Also, you should have mentioned what is the opinion of your own lawyer on your questions?

However, on the basis of deficient background it can be said, nothing can be forced on the opposite party without the specific order of the competent court.
