Hi,
My wifehas filed evidence by way of affidavit. SO how to counteract to this. Do I have to cross examine the evidence or s there any way to reject the same.Advice in light of Law

without cross examination the evidence can not be treated as completed., cross examination is your rights..

I oppose the words used in this forum. Mr. tom & laxman what is this ? are you not aware of the word used by the author. you simply answering the same. there should be dignity maintained.

Dear Samina,
First of all, all members must accept Mr. Barman's Warning. "No abusive language, and woman's modesty must be protected.
U mean u appeared w/o VP?? in wh court?
If u have no knowledge of such vital legal procedure, u must hire advocate.
Though we understand u r disturbed, boiling, angry, that shakes LCI public platform , one must be cool, avoid head-on collision, do not spoil public image. If u can write these to LCI Experts on Public Platform, what u must have done to your Wife in ur home in closed door. ?? so cool down, at least don’t do the same in public.
U or ur Lawyer have to cross Examine her. If u fail, whatever she filed, court will accept her affidavit as true and correct, proves to be true, and it will go against you. U seems not to be in proper state of mind, and u insist upon the court to accept ur V.P., Let ur Advocate do the needful for u.
Be Polite now onwards, everywhere, and it will reward u. If u don’t follow this advice, it may ruin ur life. No life without wife. “Nari tu narayani” and “Devi” , it change the world from hell to heaven. Look deep into yourslf, probably you will find the root cause, and remove it before it is too late. Dose may be necessary to her also.
Bitter dose can cure you.

in civil cases evidence in chief is by affidavit.

An affidavit in civil cases is treated as examination in chief,then the opposite party has to cross examine the deponent witness unless one does not want to challenge the veracity of the evidence of the deponent witness.
