Eviction case

case filed ag me for non payment of rent. idid not file w/s nor appeared and case was adjourned for exparte evidence of plaintiff. i requested court to set aside exparte evidence. court agreed and poste case for consideration assessment of rent. can on fixed date i can be absent to drag the case further or court can do cosideration and assessment of rent in my absence

Yes, Court can deternine/assessment of rent in your absence and failure to deposite/pay the determined rent court will pass the order to struck off your defence.

Your absence on the hearing date, particularly when the already set case for ex-parte was agreed to be heard on your own request, would definitely benefit the landlord. Ex-parte would not be avoided in any case on 2nd occasion of intentional absence. Mr. Subramanian seems to be right in his observation about your intentional harassment to the landlord.
