Enquiry related to my arrears and Gratuity

Querist : Anonymous (Querist) 11 March 2019 This query is : Resolved
Hello

I was working as a TGT in one of the repute private schools of Delhi. My date of joining on my character certificate is from 7th July 2012 to 30th March, 2013 and from 9th July, 2013 till 31st July, 2018. Though I joined on 3rd April, 2012 and left on 31st July, 2018. I gave my formal resignation letter and served 3 months as well after submitting my resignation.
My School distributed first part of arrears in October, 208 and second part on January, 2019. I have not received any payment yet. Secondly, as per to my work experience, I have worked for 6 years and 3 months with full continuation.
I here seek guidance from you on how to apply for my arrears and gratuity, which is due from my employer. I have made numerous calls already and sent a mail as well but not response from their end till now.
Please help.

Regards

Have you sent written request to release your dues ? If so, what is the result ? If not, apply now.
However, if you feel so, you may sent a legal demand notice through a local prudent lawyer.

Why anonymous ? Disclose your identity for better / more response.

Mere calls cannot compel the school to comply with your request. Formal application is a must for payment of gratuity. If still the school authorities refuse to pay you gratuity or raise some objection, only then seek help of the experts.

You should claim the benefits by way of detailed written representation and give then some time for settlement. If they failed to pay approach to labor court for your grievances. You will get your dues paid adequately .

Yes Sir/ Madam, I made several calls and sent a letter on 04th March, 2018 and requested them to clear my all dues but till now no response from their end.
Once on phone I was told that I dont come into the criteria for attaining Gratuity. According to them though I am giving my services from 2012 but I got Permanent in the year 2014. To this I told them that I was appointed as a teacher on TGT Scale and so if you are deducting PF from my salary then I clearly deserve Gratuity as my total serving period is 6 years and 3 months.

I am really grateful to you all for helping me at this stage when I lost all trust. Please enlighten me more that after sending one letter, how much more time I need to wait and what to do next to make my case more strong.

Thank you

Sincere regards
