Encroachment to leased property

(Querist) 30 January 2015 This query is : Resolved
Sir
Due to the non payment of monthly rent for the leased property, the lessor encroached the demised property and switched off the electricity connection to the equipment installed in the property and caused loss to the lesee.
In this circumstance, whether a complaint can be registered in local police station against lessor and provide a draft letter to the police station.
Advocate Ravinder (Expert) 30 January 2015
For non payment of the rent, he cannot cut electric supply. You can give complaint to police for creating nuisance. If there is no action from local police meet DCP or commissioner of police.

If the owner wants any relief, he has to approach the civil court, but cannot cut electric connection.

T. Kalaiselvan, Advocate (Expert) 01 February 2015
The owner cannot deny the basic amenities and he cannot indulge in such activities like disconnecting the electricity or water supply, it is illegal, he can be taken into task, you can lodge a criminal complaint against him besides obtaining an injunction order against him from a civil court.
