Employment bond

Hello Sir, My self Shiva I joined a company X on January 2016 now 1 year 9 months are over but till now i didn't got a appraisal and i signed employment bond for 3 years with my original marks cards.

Now i want to clarify if i want to leave the company right now with revealing letter along with my original marks card, i need to pay bond amount?

Bond means you are bound to fulfill the terms agreed upon. You will have to pay the bond amount.

I do not like any comment on other experts, if I differ any point I do so with proper respect and honor.


I never initiate such comment / action, just try to contradict / reply when on me / on other experts in wrong way / unwanted / for satisfaction of ego.

Employment bond cannot enforced unless the employer had incurred substantial expendiure in imparting specialised training to the employee.

Easy said than doing. A bond, if signed by an employee, is a costly affair to get rid of that too if tried through litigation. The employee should not forget that he would spend a lot from his own pocket and waste a lot of precious time of years together up to the level of Supreme Court, while the employer just books that expenditure against his profits and get exemption from taxation also.

If the employer gets a bond signed by the employee he cannot be said to be so idiot not to include the clauses in his favour to get that implemented legally and to simply termed as non-enforceable.

More so, if an employee signs a bond, he is required to think judiciously at the time of entering in to service, why he is signing a bond. Even if he challenges the bond in the court of law that too while leaving service, he has to spend a lot on litigation, as stated above, and also have to produce enough evidence to prove his stand, not to be termed as after thought.

The most important aspect here in this case is that the querist will have to wait for release of mark sheet for years together till he finally wins the battle, that too, if he has any proof to have deposited the mark sheet with the employer under acknowledgment.

With reference to the deep analysis of Mr. Jigyasu, as above, I am also of the view that before rendering an advice, an expert should go deep in to the pros & cons of the issue. Free advice here is just a clue right or wrong start up for the querist, but implementation depends upon the right course of action, which involves cost and time factor also as well as choosing the right direction for the action. Any casual advice or wrong route, if adopted, for implementation of advice, not only costs a lot to the querist, but also may cause frustration in the mind of the querist.

Rest depends upon the wisdom, nature and knowledge of the experts at this forum.

The concerned Child should concentrate on completing its home work on time with out wasting time or there would be chances of getting beatings from its class miss.
