Effectiveness of consumer courts

(Querist) 26 July 2014 This query is : Resolved
As per our lawyer going to consumer courts is a waste of time as very few CHS gets compensated in a timely manner. As per the lawyer it takes many years to get sufficient compensation. Is it true that although newspapers publish the news of consumer courts granting compensation actually very few get compensated as the builders go in appeal and ultimately CHS gets frustrated due to long long delay and give up the fight? Is it not lack of justice for consumers in India due to inefficient government which is insensitive to the flat buyers?
Devajyoti Barman (Expert) 26 July 2014
On the very contrary the cases pending in Consumer forums are disposed of quite faster than the regular civil suits.

Your query is not specific. As regards disposal, I too agree with Shri Barman.

The enforcement of Law requires certain rigours, from the litigants, their counsels and the presiding officers. However, there is serious deficit in this context in all the forums, the Supreme Court & the High Court included. There is no immediate solution in sight.

Cases normally disposesed of in a year or two if both litigants n lawyers attending the matter n time taken generally is less than civil courts.
K.K.Ganguly (Expert) 27 July 2014
1. My experience is completely different,

2. Consumer Fora disposes of cases very fast, even much faster that Debt Recovery Tribunals,

3. I find filing of applications before Consumer Dispute Redressal Fora are very effective and least time consuming.
Rajendra K Goyal (Expert) 27 July 2014
Consumer forum follows procedure and can not decide without giving proper chance to both parties. The disposal is faster in general. Some litigants get benefit of the procedure and delays the decision.
Advocate Bhartesh goyal (Expert) 27 July 2014
I do agree with Mr K.K.Ganguly.
Raj Kumar Makkad (Expert) 28 July 2014
I have also similar opinion.
V R SHROFF (Expert) 28 July 2014
CASES IN CONSUMER COURTS ARE DISPOSED OFF FASTER THAN IN CIVIL COURT.

+ NO COURT FEES, SO ALMOST FREE+ NO NEED FOR ADVOCATE, IT IS SIMPLE PROCEDURE..

So I do not agree with Querist's view..

Depends upon how effectively your lawyer presents the case in the forum. Only disinterested or incompetent lawyers can say so, as your lawyer has tried to mislead you. You can fight your case, yourself also.
T. Kalaiselvan, Advocate (Expert) 29 July 2014
Well advised by the experts, you may follow their advise instead of getting further misguided or remain misguided by your advocate's words.
Dr J C Vashista (Expert) 29 July 2014
I have also similar opinion.
