Ec vs sale deed

Hi,

There is a difference in Plot number mentioned in EC and Sale Deed.

How to find out the correct one.

As per EC plot no. is 252, whereas Sale Deed is having plot no. as 282. Rest all are matching.

Please advise.

In that case obtain EC for plot no. 282. Then you will come to know the exact position.

Encumberrance Certificate is only based on the documents that were registered only. Meet the Concerned Registrar and Clarify.

Search where the error exist and after finding it get the documents rectified accordingly. If necessary, get the rectification deed executed and registered.

Actually, we are not sure, which one is correct.

Plot number mentioned in EC or Plot number mentioned in Sale Deed.

Assume that while asking whether there is any EC in respect of Black Horse (Plot 252) . The EC says that there is no encumbrance against Black Horse(Plot 252).

But you have purchased a Grey Horse (plot 282). Therefore, unless you have a separate EC for Grey Horse (plot 282), you cannot say that you obtained necessary EC before purchasing.

Further, even assuming that the seller does not have any other plot other than plot No.282, then in that case you would not be having any difficulty in the Sale Deed - as the property was plot 282 and not 252. Therefore, the EC of 252 need not worry you. Both are separate documents.

But only when you want to be doubly sure that plot No.282 does not have any EC, then you have no other go than to obtain a separate EC for plot 282.

That's why I said that obtain a EC for plot 282. Rest is your decision.

What is mentioned in the Parent Document the Documents of the Seller.With all this Seek the Help of Surveyor and Registrar.If Necessary Get Executed a Rectification Deed with Corrections.
