(Querist) 13 October 2017 This query is : Resolved
Hi,
I am working with the bank and I am on my 3 months notice period and I have served 1.5 months of notice period already ..during my notice period I injured my ankle when I was leaving from work and inspite of my bank being accommodating my boss started menatally harrasing me and when told this to Hr they were of no help either..I coudnt take hr yelling at me so I left work dropping an email that they should get in touch with me on my personal email..I no longer wish to go to work I am highly disturbed also with my injured feet it is difficult for me to continue my services there..what can I do to get early relieving?

No legal recourse against the terms of appointment is possible.

Your statement that you have left work dropping email that they should get in touch with you on your personal mail is like an order to your employer. Why do you believe that instead of taking any disciplinary action against you for desertion of your duty, why your boss or HR would get in touch with you, as it is you, who require some concession from them, not they have been obliged by you on some meritorious or rewarding task?

Ms. Sheena,

Without sympathetic consideration by your boss and HR, nothing favourable can be expected by you as against the terms of appointment.

So, it is for you or your bank union how to convince your boss/HR to help you.

However, if provision of buy back of the notice period is available in your terms of appointment, you can make use of that.

@jigyasu- I told them that I am going home to get better because of my foot injury..i complained to hr about my manager attitude which is highly disrespectful and abusive still they asked me to continue working and my hr started yelling at me that I need to complete my notice period.
I just find it difficult to set foot in that office.

@dhingra-paying back of notice period is not given in my offer letter.

It is better to complete the notice period as per appointment terms if you are in a position to do so.

Get a medical certificate from doctor regarding your injury and advice for complete rest, send leave application with copy of medical certificate.

To avoid disciplinary action on being treated as on unauthorised absence, it is better to complete the notice period by attending office.
