Hi All,

My filed DV case and asking for 30k amount per month. Also claiming 50Lkah for Child Maitenance. She asked to produce salary slip of me. Though my grosss is higher but inhand salary is low. deduction is PF, VPF,NPS,TAX etc. She is engineer (Never did Job) but capable of doing job. What will be the court view?

You net salary will be considered, you are liable to give maintenance to your Child, as per your wife qualification she can ask to earn.

Son is the responsibility of both Mother and Father so in that case the maitenance of child should be equally divided by Mother and Father. Wife is highly qualified and can earn independently. What will be court view in this case ?

Also My DV case filed on 15 April 19 and end of this month we have final argument with Payout. I have taken the Loan against property whose first EMI will start in August month so in that case shall I provide the loan docs to court so that it will show the liability on me. Does it Impact on maitenance ?

Court will take into consideration all the realities and the reason why wife is not going to the job and her prospective earnings if she goes to job will be taken into consideration before passing any order for grant of maintenance.
