Divorce petition transfer -any time limit ?

Dear All Adviser,

I want to ask you three question...

1.Any time limit for high court application for transfer divorcee petition one district to other district. After attend 3 / 4 hearing can i apply for high court transfer the case in my home town.they take any objection on me.

2. How much period required for high court for take a final decision for transfer petition. One or two month or take longer .

3. Meanwhile can i told my court ( now where my husband file a divorcee case ) please stop the hearing . is that possible.Or h

1. You can apply for transfer at any point of time.
2. In calcutta high court it takes not moe than 4 weeks.
3. Yes stay may be granted.

I agree with the expert advise of Mr. Devajyoti Barman.
Time taken in transferring the case differs from Court to Court. Delhi and Punjab & Haryana High Courts take about 6-7 months ((minimum) and generally decline (both High Courts) stay of proceedings.

1) You can apply for the transfer of the case at any time before the trial or during the trial, there is no limitation on it.

2) It depends from Court to court and State to State generally it takes minimum six months.

3) No, you can not stop or put on stay proceedings of the court where the case is currently running, only the High Court concerned and in case of the inter state transfer Supreme Court can put stay on the lower court proceedings (Here I differ from all above Experts, please not.)You have to demand the stay by an interim application to the HC; side by side a demand for the transfer of the case by petition.

Now i am already paid my fees to advocate.

The problem was my advocate have lot of other case so he can't possible to give time to my query.

@Magee,
If your counsel is unable to attend your case/query it is advisable to change him/ her. Put up your queries in one go, not in peacemeal, at his/ her convenient time/ place (as per appointment)
On the other hand disturbing him/her at his/her Court/odd hours will get the similar reply from almost every advocate, please note.
